1. ACCEPTANCE OF TERMS
Welcome to Future Stars! These Terms of Service ("Terms") govern your use of the Future Stars mobile application and website (collectively, the "Service"), operated by Future Stars Lab Inc., a Delaware corporation ("Future Stars," "we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.
FOR USERS UNDER 18: If you are under 18 years old, your parent or legal guardian must read and agree to these Terms on your behalf before you can use Future Stars.
2. ELIGIBILITY AND PARENTAL CONSENT
2.1 Age Requirements
Future Stars is designed for children ages 10-14. Users must meet the following requirements:
- Children under 13: Must have verifiable parental consent before creating an account or using the Service.
- Children 13-17: May use the Service but we strongly encourage parental involvement and oversight.
- Adults 18+: May create accounts to supervise their children's use.
2.2 Parental Consent
For users under 13, we require verifiable parental consent in compliance with the Children's Online Privacy Protection Act (COPPA) and General Data Protection Regulation (GDPR). Our consent process works as follows:
- The child enters their birth year during onboarding
- If under 13, we request a parent/guardian email address
- We send a verification code to the parent's email
- The parent enters the code to verify their identity
- The parent completes the account setup for their child
Parents must:

- Understand what information we collect from their child
- Agree to these Terms on behalf of their child
Parents may revoke consent at any time by contacting us at privacy@futurestars.com.
2.3 Parent/Guardian Responsibilities
If you are a parent or guardian providing consent:
- You are responsible for your child's use of the Service
- You agree to monitor your child's account and activity
- You acknowledge that you have the authority to agree to these Terms on behalf of your child
3. ACCOUNT CREATION AND SECURITY
3.1 Account Registration
To use Future Stars, you must create an account. When creating an account:
Children must provide only a nickname (not their real name)
Children under 13 must provide their birth year
Parents must provide accurate contact information (email address)
You must not impersonate others or provide false information
You are responsible for maintaining the confidentiality of your account credentials
3.2 Account Security
You are responsible for:
All activities that occur under your account
Maintaining the security of your password
Notifying us immediately of any unauthorized use at privacy@futurestars.com
3.3 Account Termination
We reserve the right to suspend or terminate accounts that:
Violate these Terms
Engage in harmful or inappropriate behavior
Provide false information
Remain inactive for 1 year or more
Parents may request deletion of their child's account at any time by contacting privacy@futurestars.com. Upon deletion, all personal data will be removed within 30 days.
4. USE OF THE SERVICE
4.1 Permitted Use
You may use Future Stars to:
- Access mental performance training content
- Track your progress through challenges and exercises
- Learn skills related to focus, confidence, and resilience in tennis
- Interact with Oracle, our AI-powered personalized mentor
4.2 Prohibited Use
You may NOT:
- Use the Service for any illegal purpose
- Violate any laws in your jurisdiction
- Harass, abuse, or harm others
- Attempt to hack, disrupt, or damage the Service
- Collect information about other users
- Share your account credentials with others
- Use automated tools (bots, scrapers) to access the Service
- Reverse engineer or attempt to extract source code
- Remove or alter any copyright or proprietary notices
- Use the Service in any way that could harm children
4.3 Content Guidelines
Future Stars is a safe space for young athletes. Users must not:
- Post or share inappropriate content
- Use offensive language
- Share personal information publicly
- Engage in bullying or harassment
4.4 Oracle Conversations
Oracle is an AI-powered mentor designed to support your mental performance development.
Guidelines for Oracle use:
- Oracle conversations are stored to provide personalized support and track your progress
- Do not share sensitive personal information (full name, home address, phone number, school name) in conversations with Oracle
- Oracle provides educational guidance, not professional medical or psychological advice
- Parents can review and delete Oracle conversations at any time by contacting privacy@futurestars.com
When using Oracle, you may NOT:
- Share personal identifying information beyond your nickname
- Attempt to bypass safety filters or guardrails
- Use Oracle to harass, harm, or collect information about others
- Attempt to jailbreak or manipulate the AI system
Important: If you or your child are experiencing a mental health crisis, please contact a qualified healthcare provider or call a crisis helpline immediately. Oracle is not a substitute for professional help.
5. INTELLECTUAL PROPERTY
5.1 Our Content
All content on Future Stars, including but not limited to:
- Text, graphics, images, videos
- Characters, stories, and challenges (including Oracle)
- Software, code, and design
- Trademarks and logos
is owned by Future Stars Lab Inc. or our licensors and is protected by copyright, trademark, and other intellectual property laws.
5.2 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the Service for personal, non-commercial purposes
- Download and use the mobile application on your device
You may NOT:
- Copy, modify, or distribute our content
- Create derivative works
- Use our content for commercial purposes
- Remove copyright or proprietary notices
5.3 User-Generated Content
If you provide feedback, suggestions, or ideas about Future Stars (including feedback about Oracle):
- You grant us a worldwide, royalty-free license to use that feedback
- We may incorporate your suggestions without compensation
- You represent that you have the right to provide such feedback
6. BETA TESTING
Future Stars may be offered in beta or testing phases. During beta:
- The Service may contain bugs or errors
- Features may change or be removed without notice
- We may collect feedback to improve the Service
- The Service is provided "as is" during testing
- We make no guarantees about availability or performance
Beta testers agree to:
- Provide honest feedback when requested
- Report bugs or issues to support@futurestars.com
- Not share beta access with others without permission
- Understand that beta features may not appear in the final product
7. PRIVACY AND DATA PROTECTION
7.1 Privacy Policy
Your use of Future Stars is governed by our Privacy Policy, which explains:
- What information we collect (nickname, birth year, parent email for users under 13, Oracle conversations)
- How we use that information (app functionality, personalization, analytics)
- Third-party services we use (Firebase, Open AI, SendGrid)
- Your rights regarding your data (access, deletion, data portability)
- Our COPPA and GDPR compliance practices
Oracle conversations are stored to provide personalized support and are automatically deleted after 90 days. Parents can request immediate deletion at any time.

7.2 Data Security
While we implement reasonable security measures to protect your information, including:
- Encryption of data in transit and at rest
- Secure password storage using industry-standard hashing
- Regular security assessments
- Limited employee access to data
No system is completely secure. You acknowledge that:
- We cannot guarantee absolute security
- You use the Service at your own risk
- We are not responsible for unauthorized access beyond our reasonable control
7.3 Parental Rights
Parents of children under 13 have the right to:
- Review what information we've collected about their child
- Review their child's Oracle conversations
- Request deletion of their child's account and all associated data
- Revoke consent and prevent further data collection
- Refuse to allow further collection of their child's information

Response time: We will verify your identity and respond within 72 hours.
7.4 Data Storage Location
Your data is stored on Google Cloud Platform servers located in the European Union. By using Future Stars, you consent to the storage and processing of your data in the EU in accordance with our Privacy Policy and GDPR requirements.
If you access our app from outside the EU, your information will be transferred to, stored, and processed in the EU where our servers are located.
8. PAYMENTS AND SUBSCRIPTIONS
8.1 Current Pricing
Future Stars is currently offered:
Free access during beta testing
Paid subscriptions will be available after full launch
All prices will be in US Dollars unless otherwise stated and are subject to change with notice.
8.2 Future Subscriptions
When subscriptions become available:
You will be charged the subscription fee at the start of each billing period
Subscriptions automatically renew unless cancelled
You may cancel at any time through your device's app store settings
Cancellation takes effect at the end of the current billing period
No refunds for partial periods
8.3 Payment Processing
Payments will be processed through:
Apple App Store (for iOS)
Google Play Store (for Android)
Payment terms are governed by the respective app store's terms of service.
8.4 Refunds
Refund requests should be directed to the app store where you made your purchase. We may offer refunds at our discretion for:
Technical issues preventing use of the Service
Unauthorized charges
Other exceptional circumstances
8.5 Parental Approval
For users under 18, any future in-app purchases require:
Parental approval through device settings
Payment method controlled by parent/guardian
Parental awareness of charges
9. DISCLAIMERS AND LIMITATIONS OF LIABILITY
9.1 Service "As Is"
FUTURE STARS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free service
Accuracy or reliability of Oracle's responses
9.2 No Professional Advice
Future Stars, including the Oracle AI mentor, provides educational content about mental performance and athletic development. We do NOT provide:
Medical advice, diagnosis, or treatment
Psychological counseling or therapy
Crisis intervention services
Professional coaching services
Treatment for mental health conditions
Oracle is an educational tool, not a mental health professional. If you or your child are experiencing:
Thoughts of self-harm or suicide
Severe anxiety or depression
Trauma or abuse
Any mental health crisis
Please immediately contact:

Oracle should never be used as a substitute for professional mental health care.
9.3 Results Not Guaranteed
While we design Future Stars to help young athletes develop mental skills:
We make no guarantees about specific outcomes
Results may vary based on individual effort and circumstances
Improvement depends on consistent practice and application
Oracle's guidance is educational, not a guarantee of performance improvement
9.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
FUTURE STARS LAB INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, or goodwill
- Service interruptions or errors
- Any damages arising from your use or inability to use the Service
- Any harm resulting from Oracle conversations or advice
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO FUTURE STARS IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.
9.5 Jurisdictional Limitations
Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In such cases, our liability is limited to the maximum extent permitted by law.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Future Stars Lab Inc., its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Content you provide or actions you take (including Oracle conversations)
- Your child's use of the Service (if you are a parent/guardian)
11. THIRD-PARTY SERVICES AND LINKS
11.1 Third-Party Services
Future Stars uses the following third-party services:
Firebase (Google): Authentication, database, cloud functions, and analytics

- Data shared: User authentication data, app usage data, analytics data
Open AI (Chat GPT): Powers the Oracle personalized mentor feature

- Note: Open AI does not use API data to train AI models
SendGrid (Twilio): Email delivery for parental verification

Google Cloud Platform: Data hosting in the European Union

These services have their own terms and privacy policies. We are not responsible for their practices, but we carefully select partners that maintain high privacy and security standards, especially for children's data.
11.2 External Links
Our Service may contain links to external websites (rare, as we limit external links for child safety).
- We do not control external websites
- We are not responsible for their content or practices
- Your use of external sites is at your own risk
- Review their terms and privacy policies
- External links require parental gate confirmation for users under 13
12. CHANGES TO THE SERVICE
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time
- Change features, content, or functionality (including Oracle)
- Update the app with new versions
- Require updates to continue using the Service
We will provide reasonable notice of material changes when possible, particularly for changes affecting Oracle or core features.
13. CHANGES TO THESE TERMS
We may update these Terms from time to time. When we do:
- We will update the "Last Updated" date at the top
- We will notify you of material changes via email or in-app notification
- Continued use of the Service constitutes acceptance of new Terms
- For material changes affecting children's data collection or Oracle functionality, we will obtain renewed parental consent where required by law
You should review these Terms periodically for changes.
14. TERMINATION
14.1 Your Right to Terminate
You may stop using Future Stars at any time. Parents may request deletion of their child's account by contacting privacy@futurestars.com.
Upon deletion:
- All personal information will be deleted within 30 days
- This includes nickname, Oracle conversations, activity data, and progress
- Some anonymized data may be retained for legal compliance
- You will receive email confirmation when deletion is complete
14.2 Our Right to Terminate
We may suspend or terminate your access to the Service:
- For violation of these Terms
- For illegal or harmful conduct
- For extended inactivity (accounts inactive for 1 year may be automatically deleted)
- At our discretion with or without notice
14.3 Effect of Termination
Upon termination:
- Your right to use the Service immediately ceases
- We will delete your account and data according to our Privacy Policy
- Provisions that should survive termination (e.g., intellectual property, disclaimers, indemnification) will continue to apply
15. DISPUTE RESOLUTION
15.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
15.2 Informal Resolution
Before filing a claim, you agree to contact us at legal@futurestars.com to seek informal resolution. We will attempt to resolve disputes through good-faith negotiation.
15.3 Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
If we cannot resolve a dispute informally, you agree that:
- Disputes will be resolved through binding arbitration
- Arbitration will be conducted by the American Arbitration Association (AAA)
- Arbitration will take place in Delaware or virtually at your option
- You waive your right to a jury trial
- You waive your right to participate in class action lawsuits
Exceptions to Arbitration:
- Small claims court matters (under jurisdictional limits)
- Intellectual property disputes
- Requests for equitable relief
15.4 Opt-Out of Arbitration
You may opt out of this arbitration agreement by sending written notice to legal@futurestars.com within 30 days of first accepting these Terms.
15.5 Class Action Waiver
You agree that disputes will be resolved individually, not as part of a class action or consolidated proceeding.
16. GENERAL PROVISIONS
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Future Stars Lab Inc. regarding use of the Service.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
16.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
16.5 No Agency
Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Future Stars Lab Inc.
16.6 Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control (e.g., natural disasters, wars, pandemics, government actions, internet outages).
16.7 Export Compliance
You agree to comply with all applicable export and import laws and regulations.
16.8 Data Retention
We retain your information as follows:
- Active accounts: Data retained while account exists
- Oracle conversations: Automatically deleted after 90 days
- Deleted accounts: Personal data deleted within 30 days of request
- Inactive accounts: Accounts inactive for 1 year may be automatically deleted
- Anonymized data: May be retained for legal compliance and analytics
Parents can request immediate deletion of their child's data at any time by contacting privacy@futurestars.com.

18. ACKNOWLEDGMENT
BY USING FUTURE STARS, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms
- You agree to be bound by these Terms
- If you are a parent/guardian, you have the authority to agree on behalf of your child
- If you are under 18, your parent/guardian has reviewed and agreed to these Terms
- You understand that Oracle is an educational tool, not a substitute for professional advice
- You will not share sensitive personal information in Oracle conversations
